Terms of Service

1. Acceptance of These Terms

These Terms of Service (the "Terms") are a binding agreement between you and SpeedScale LLC ("SpeedScale," "we," "us," or "our"). They govern your use of our website at speedscaleapp.co (the "Site") and every mobile application that SpeedScale publishes, operates, or distributes, whether available today or released in the future (each an "App," and together with the Site, the "Services"). By accessing the Site, or by downloading, installing, or using any App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Individual Apps may come with supplemental terms, in-app rules, or feature-specific notices (for example, rules for a particular game mode or community feature). Those supplemental terms are part of your agreement with us for that App. If a supplemental term conflicts with these Terms, the supplemental term controls for that App only.

2. Eligibility

You must be at least 13 years old to use the Services. The Services are not directed to children under 13, and we do not knowingly allow them to use the Services. If you are under the age of legal majority where you live, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Services, you confirm that you meet these requirements and that you are not prohibited from using the Services under any applicable law.

3. The Services

SpeedScale is an app studio that designs, develops, publishes, and operates mobile applications, in some cases in partnership with creators and other collaborators. The Services include:

The Site, where we describe our studio and our Apps; and
Our Apps, distributed through platforms such as the Apple App Store and Google Play.

Each App is different. Features such as accounts, subscriptions, push notifications, and user-generated content are available in some Apps and not others, and a given provision of these Terms applies to you only to the extent the relevant feature exists in the App you are using. Some Apps may send you push notifications; you can turn these off at any time in your device settings.

4. Accounts and Security

Some Apps let you create an optional account. If you create one, you agree to provide accurate information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us at speedscaleteam@gmail.com if you suspect any unauthorized use of your account.

You may stop using an account at any time, and where an App offers account deletion you may delete your account through the App or by contacting us. We may suspend or close accounts as described in Section 13 (Termination).

5. Purchases, Subscriptions, and Billing

Some Apps offer in-app purchases, including one-time purchases and auto-renewable subscriptions. All purchases in our Apps are billed by, and processed through, the Apple App Store or Google Play (each, an "App Store Platform"), not by SpeedScale directly. Your purchase is also subject to the App Store Platform's own terms.

Auto-renewal. Subscriptions renew automatically at the end of each billing period, at the then-current price, unless you cancel at least 24 hours before the current period ends. Your App Store Platform account is charged for renewal within 24 hours before the end of the current period.
Cancellation. You must cancel through your App Store Platform account settings (for example, your Apple ID or Google Play subscription settings). Deleting an App does not cancel a subscription.
Refunds. Refunds are handled by the App Store Platform under its policies. We do not control App Store Platform refund decisions, though you are welcome to contact us and we will try to help.
Free trials and introductory offers. Unless you cancel before a trial or introductory period ends, it converts to a paid subscription at the stated price. Where offered, any unused portion of a free trial is forfeited when you purchase a subscription.
Price changes. Prices may change. For subscriptions, price changes take effect at your next renewal, following any notice and consent process the App Store Platform requires. If you do not agree to a new price, you can cancel before it takes effect.

Virtual items, credits, or other in-app content have no monetary value, are licensed to you rather than sold, and cannot be transferred or redeemed for cash except where required by law.

6. Acceptable Use

You agree to use the Services only for lawful purposes. When using the Services, you must not:

Violate any applicable law or regulation, or infringe anyone's rights;
Harass, threaten, defame, or abuse others, or post content that is hateful, obscene, exploitative, or otherwise objectionable;
Impersonate any person or entity, or misrepresent your affiliation with anyone;
Upload malware, interfere with or disrupt the Services, or attempt to gain unauthorized access to any systems, accounts, or data;
Scrape, harvest, or collect data from the Services except as we expressly permit;
Reverse engineer, decompile, or attempt to extract the source code of any App, except where the law permits this despite this restriction;
Cheat, use bots or automation, or exploit bugs to gain an unfair advantage in any App;
Resell, sublicense, or commercially exploit the Services without our written permission.

We may investigate suspected violations and take any action we consider appropriate, including removing content, restricting features, and suspending or terminating access.

7. User Content

Some Apps allow you to create, upload, or share content such as text, images, audio, video, or gameplay creations ("User Content"). This section applies only to Apps that accept User Content.

You keep ownership of your User Content. So that we can operate the Services, you grant SpeedScale a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, display, and distribute your User Content in connection with operating, promoting, and improving the Services. This license ends when your User Content is deleted from our systems, except for copies retained for backup or legal purposes and content that others have already shared through the Services.

You are responsible for your User Content. You represent that you have all rights needed to post it and that it does not violate these Terms or any law. We do not endorse User Content and are not obligated to monitor it, but we may remove or restrict any User Content at any time, for any reason, without notice. If you believe content on the Services infringes your copyright or other rights, contact us at speedscaleteam@gmail.com with enough detail for us to review the claim.

8. Intellectual Property

The Services — including all software, designs, graphics, logos, text, and other content we or our licensors provide — are owned by SpeedScale LLC or its licensors and are protected by intellectual property laws. Except for User Content, we and our licensors retain all rights in the Services.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Site and to install and use our Apps on devices you own or control, for your personal, non-commercial use. No other rights are granted. Our names, logos, and App names may not be used without our prior written permission.

If you send us feedback, ideas, or suggestions, you agree we may use them without restriction or compensation to you.

9. Third-Party Services and Links

The Services rely on and may link to services operated by third parties, including the App Store Platforms, payment processing, analytics providers, advertising partners, social features, and external websites. We do not control these third parties, and your use of their services is governed by their own terms and privacy policies. We are not responsible for third-party services or content, and a link from the Services does not mean we endorse it.

The App Store Platforms are not parties to these Terms and have no obligation to provide support or maintenance for our Apps. To the extent an App Store Platform's terms require additional provisions to apply between you and us, those provisions are incorporated into these Terms. You and we acknowledge that each App Store Platform and its subsidiaries are third-party beneficiaries of these Terms as they apply to your license of the relevant App, and upon your acceptance of these Terms they have the right to enforce these Terms against you as a third-party beneficiary.

10. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, SpeedScale and its members, managers, employees, partners, and licensors disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content or results obtained through the Services will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, SpeedScale and its members, managers, employees, partners, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising out of or related to the Services or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid through the Services in the 12 months before the event giving rise to the claim, or (b) 100 US dollars.

Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SpeedScale and its members, managers, employees, partners, and licensors from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party. We may assume the defense of any matter subject to indemnification by you, in which case you agree to cooperate with us.

13. Termination

You may stop using the Services at any time by deleting the relevant App and, where available, deleting your account. We may suspend or terminate your access to any or all of the Services, or any account, at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue a Service.

Upon termination, the licenses we granted you end and you must stop using the affected Services. Sections that by their nature should survive termination — including provisions on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

14. Changes to These Terms and the Services

We may update these Terms from time to time. When we make material changes, we will take reasonable steps to notify you, such as posting the updated Terms on the Site or providing an in-app notice, and we will update the effective date above. Your continued use of the Services after changes take effect means you accept the updated Terms. If you do not agree, stop using the Services.

We are always improving our portfolio, and we may add, change, suspend, or discontinue any App or feature at any time, including features you may have enjoyed for free. Where a change materially affects a paid subscription, your remedies are through the applicable App Store Platform as described in Section 5.

15. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which SpeedScale LLC is organized, without regard to conflict-of-law rules, except where the mandatory consumer protection laws of your place of residence apply and cannot be waived.

If you have a dispute with us, please contact us first at speedscaleteam@gmail.com — most concerns can be resolved quickly and informally. If we cannot resolve a dispute informally, it will be brought exclusively in a court of competent jurisdiction, and each party consents to that court's jurisdiction. To the extent permitted by law, each of us agrees that any dispute will be resolved on an individual basis and not as part of a class, consolidated, or representative action, and any claim must be filed within one year after it arises or it is permanently barred. Nothing in this section prevents you from bringing claims in small-claims court or from exercising non-waivable rights under the laws of your place of residence.

16. General Terms

These Terms, together with our Privacy Policy and any supplemental terms for a specific App, are the entire agreement between you and SpeedScale regarding the Services and supersede any prior agreements on that subject. If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms or your account without our prior written consent; we may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms do not create any agency, partnership, or joint venture between you and SpeedScale, and there are no third-party beneficiaries except as expressly stated in Section 9.
